Terms of service

Blue Sky Hosts provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Blue Sky Hosts are subject to the following terms of service.

Indemnification

You agree to use all Blue Sky Hosts services and facilities at your own risk. Blue Sky Hosts specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Blue Sky Hosts be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Blue Sky Hosts harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Blue Sky Hosts, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.

Blue Sky Hosts reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Blue Sky Hosts shall be the sole judge of what violates this Policy.

Data backup and storage

Blue Sky Hosts provides backup and storage services as part of its hosting solutions; however, these backups are not guaranteed, and data integrity is not assured. While we take reasonable measures to protect and store data, Blue Sky Hosts shall not be held liable for any loss, corruption, or failure of data stored on our servers.

Client responsibility: It is the sole responsibility of the client to maintain up-to-date and independent backups of all their data.

Billing

We bill according to the plan you choose — monthly, quarterly, semi-annually or annually. If you are not satisfied within your first 30 days we would be happy to provide a full refund (for some special offers the money-back period may vary; domain name registration fees are non-refundable).

There are no contract periods, but for each successive period your service is automatically renewed unless we are notified otherwise.

Late payments

Accounts are billed according to the dates they were first activated. If payment is not received, the account may be suspended and later terminated in line with our billing reminders.

Acceptable use

All services may be used for lawful purposes only. Transmission, storage or presentation of material in violation of applicable law is prohibited. Pornography is prohibited on all Blue Sky Hosts servers. Content relating to hacking, cracking, warez and IRC is not allowed. Accounts suspended due to content or acceptable-use violations are not refunded.

Limitation of liability

Blue Sky Hosts shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from servers going offline or being unavailable. All damages shall be limited to the immediate termination of service. Blue Sky Hosts cannot be held liable for system downtime, crashes or data loss, nor for any predicted estimate of profits.

Changes

Blue Sky Hosts retains the right to change these policies. The current version is always the one published on this website.
